1. GENERAL
The following terms and conditions and all rules stated in the FAQ section apply to all orders placed by the customer (hereinafter referred to as ”you”) with Anna Oszvald Sole Proprietor, hereinafter referred to as “Anna”, ”us” or ”we”, at the www.annaoszvald.com website or mobile website. By using annaoszvald.com and/or placing an order, you agree to be bound by the terms and conditions and the rules stated in the Frequently Asked Questions (FAQ) section set out herein (the ”Terms”).
Please make sure you have read and understood the Terms and the rules written on our FAQ page before placing your order.
The inclusion of any products or services on annaoszvald.com at a particular time does not imply or warrant that these products or services will be available at any time.
We reserve the right to discontinue any product at any time.
We reserve the right to amend these Terms from time to time without prior notice to you. The version of the Terms that will apply to your order will be those on annaoszvald.com at the time you place your order.
Anna Oszvald Art Shop would like to provide the best possible online experience. To make this possible we need to ensure that our services run smoothly. You understand and agree not to (i) post, transmit, redistribute, upload, or promote any communications or content that could harm or negatively impact our business, products or services; (ii) act in a manner or employ any device that restricts, impairs, interferes or inhibits any other user from using or enjoying the annaoszvald.com site, or which impacts the security of the site, or (iii) employ any device or attempt to use any engine, software, tool, agent, script or other device or mechanism (including without limitation spiders, bots, crawlers, avatars or intelligent agents) to navigate or search the site, or to copy content from the site. We reserve the right to immediately bar access to the site and close the account of any user who violates this provision or any other provision in these terms and conditions.
2. TAXES, DELIVERY CHARGES, DUTIES
The prices displayed at each product site at annaoszvald.com include 0% VAT, and no delivery costs. The delivery costs are added at checkout. Please ensure you take into account any potential customs and import fees and taxes before you place your order. These are the responsibility of the customer and may be applied on orders shipped to countries outside the EU. If you order from a country outside of the EU, local taxes and duties may be added, for which we cannot be held responsible. If this is the case the carrier will contact you. Please note that this could involve some delay of the consignment, as the goods are retained by the customs. From this point it is your responsibility to contact the carrier and pay for the additional costs.
3. ORDERING/CONCLUSION OF CONTRACT
The ordering options available to you are via annaoszvald.com. Once you have placed your order, you will receive an email confirmation. If for any reason we are unable to fulfill your order, we will let you know. If we have already received payment for such order, we will attempt to refund the applicable amount using the same method used to make the payment. If, for any reason, alternative arrangements are necessary we will notify you and ask you to contact Anna Oszvald who will settle the refund.
4. SHIPPING
All goods can be shipped worldwide. Items which are flat and fit in an LC/6 or LC/5 envelope are delivered by local postal services - where the tracking of the package is not possible - to keep the shipping cost as low as possible. All other goods are delivered via FedEx or DPD as parcel post, which makes it possible to trace the parcel. We carefully pack goods in protective packaging to secure that products will arrive in perfect condition. However, if the content is damaged upon receipt, please report this to us immediately or at the latest 2 days after receipt to oszvaldann@gmail.com.

6. PAYMENT METHODS
All orders are processed through Braintree or PayPal, both 100% secure online payment system. Braintree encrypts your payment information using the SSL protocol with an encryption key length of 128 bits – the highest level of security for e-commerce.
We accept the following debit and credit cards: VISA, MasterCard, American Express. We don’t charge any fees for credit card payments. All prices are stated in USD and includes 0% VAT.
All communication between our payment system and the cardholder is made through an encrypted SSL-line (Secure Socket Layer). In other words only Braintree and Paypal have access to your data. It is not possible neither for us nor any other unauthorized entity to see or read data, which is exchanged in connection with the purchase.
7. OUR LIABILITY
Nothing in these Terms shall exclude or limit Anna Oszvald's liability with regard to any matter for which it would be unlawful for us to limit or exclude our liability.
We do not seek to exclude liability for fraudulent misrepresentation by us or our employees or agents. If we breach these Terms, we shall only be liable for losses which are a reasonably foreseeable consequence of such breach.
Anna Oszvald is not responsible for indirect losses which are a side effect of the main loss or damage, for example loss of profits or loss of opportunity; or for failure to deliver the goods or to meet any of our other obligations under these Terms where such failure is due to an event that is beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident and terrorist activity.
Our maximum liability to you for any loss or damage arising in connection with your order on www.annaoszvald.com shall be limited to the total price of your order.
8. COLORS
On this webshop and our social channel we aim to represent the colors of the actual artworks and display the attributes of our products accurately. However, we cannot guarantee that your computer will accurately display all colors, as the settings of your device may cause slight differences in coloring.
9. CLAIMS & WARRANTY
Please be aware, that original artworks are unique, unrepeatable, and their value is in their perfect imperfections. We always do a quality check on every artwork before shipping. However, if there are defects in the goods you have purchased, Anna Oszvald abides by all statutory guarantee regulations. If you have a complaint regarding obvious material or manufacturing faults in goods that we have supplied, please send an email to oszvaldann@gmail.com in which you describe what is wrong with the item along with your order number (found in the order confirmation e-mail) and please also include detailed pictures of the item.
10. FORCE MAJEURE
In case of force majeure Anna Oszvald has the right to cancel the contract between Anna Oszvald and the customer. A force majeure is a severe impediment in life of Anna Oszvald or transport stagnation.
11. SEVERANCE
If any part of these Terms is disallowed or found to be ineffective by any court or regulator, the other Terms shall continue to apply.
12. GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Hungary.
13. OWNERSHIP OF RIGHTS
All content on this website is protected by intellectual property rights and belong to Anna Oszvald. All intellectual property rights, such as trademarks and copyrights at www.annaoszvald.com remain with Anna Oszvald and its subsidiaries or licensors. Any use of www.annaoszvald.com or its contents, including copying, reproducing or storing such content (including all the copy, all image pictures, designs and graphics, etc) in whole or part, other than for your own personal, non-commercial use, is prohibited without the written permission of Anna Oszvald.
